School-zone fight in Seminole lingers

SANFORD -- A court battle over new attendance zones for Seminole County high schools may extend into the summer, with students wrapping up the school year unsure of where they will attend classes in the fall.

On Wednesday, Circuit Judge Debra Nelson set May 26 -- the last day of the current school year -- as the date to hear suits by two groups of parents seeking to stop the rezoning, which could affect up to 5,000 students in eight high schools.

District officials say they are moving ahead with the new attendance zones, although the court could set them aside. The School Board has scheduled a final vote on the rezoning plan for April 26.

Meanwhile, a move to recall the School Board fell flat Wednesday because local and state elections officials said it cannot be done.

"Under Florida law, there is no provision for a recall election for School Board members," said Michael Ertel, Seminole County supervisor of elections.

The Tuscawilla Homeowners Association, which is suing along with Sabal Point parents, was making plans for a petition drive to recall all five School Board members, said Damon Chase, attorney for the Tuscawilla group.

Board members can be removed from office by the governor, but only based on a violation of law or other serious infraction.

Chase hopes to convince the judge that the board violated the state's "Government in the Sunshine" open-meetings law when it took a bus tour of attendance zones and discussed changes in October.
